Dear Ms Harbison,
Thank you for your letter of November 3rd, concerning your order No. 15545. I regret that your order was not delivered by the due date. However, I must point out that, although we undertook to make every effort to deliver by the date required, we did not commit ourselves to this date.
As you know, we take orders for the fall, in May. You will remember that this was a late order which we undertook to meet by special arrangement because we have a longstanding relationship with your company. In our view, we fulfilled our obligations to you as well as could be expected in the circumstances.
I also regret that the consignment was damaged and incomplete when it reached you. I have made enquiries at this end, and I am informed that the consignment was supplied FOB, Milan. Your Italian Buying House confirms that the merchandise was in good condition when it was delivered to them. We cannot, therefore, accept responsibility or liability for the goods damaged or stolen in transit. May I suggest that you pursue the matter with your forwarding agents?
In the light of the above information, I think you will agree that we cannot accept cancellation of the order at this stage, and that you remain liable for payment of our invoice No. 42199 in full.
