Overtaking and Passing

Section 44. A driver who wishes to overtake or pass another vehicle in the roadway with no traffic lane marks shall use sound signals loud enough to let the driver who is driving the vehicle in front of his intention and, after the driver of the vehicle in front gives a responding signal pursuant to Section 37 (3) or Section 38 (3), may proceed to overtake. A driver of a vehicle shall overtake another vehicle on the right-hand side of and at suitable distance from the vehicle being overtaken and after having gone past the said vehicle for a safe distance shall steer his vehicle to and keep it on the left-hand side of the roadway.

Section 45. No driver of a vehicle shall overtake another vehicle on the left-hand side except in the following circumstances:

(1) The vehicle to be overtaken is making right turn or has given a signal that he is going to make a right turn;

(2) The roadway is arranged with two or more traffic lanes in the same direction. Overtaking a vehicle on the left-hand side under (1) or (2) shall be done only when there is no vehicle close behind or it is sufficiently safe to do so.

Section 46. No driver of a vehicle shall overtake another vehicle in the following circumstances:

(1) When he is driving his vehicle up a slope, bridge or on a curve except at a place where there is a traffic sign permitting overtaking;

(2) Within a distance of thirty meters from a pedestrian crossing, junction, circle or constructed island, or a roadway that crosses railway tracks;

(3) At the time when there is fog, rain, dust or smoke so dense that the way ahead is invisible at a distance of sixty meters;

(4) When entering critical location or safety zone.

Section 47. No driver of a vehicle shall drive his vehicle to overtake or pass another vehicle by, in doing so, going beyond the roadway’s middle line that is marked or where there is a traffic sign indicating a danger area or an area in which carefulness is required on the roadway. In the event of the left-hand side traffic lane is obstructed while the traffic lane on the right-hand side has sufficient space, a driver of a vehicle may avoid the obstructions by driving his vehicle beyond the roadway’s middle line prescribed by the traffic officer in so far as he does not obstruct the traffic of the vehicles moving in the opposite direction.

Section 48. No driver of a vehicle shall drive his vehicle to overtake or pass another vehicle by going over onto the bus lane except that there is obstruction of traffic on the roadway ahead or the driver is required to comply with the order of the traffic officer, however, for only as long as it is necessary

Section 49. Upon receiving a signal for overtaking from a vehicle immediate behind, the driver of a vehicle which is able to move at a low speed or is moving at a lower speed than that of other vehicles going in the same direction shall allow the vehicle to overtake and, in doing so, the driver being requested to be overtaken shall display a responding signal pursuant to Section 37 (3) or Section 38 (3) upon seeing that the roadway ahead is safe and there is no vehicle moving in the opposite direction in a close distance and shall reduce the speed of the vehicle and keep the vehicle close on the left-hand side of the roadway in order to let vehicle immediately behind overtake in safety.
