Introduction

Nowadays, more than ever managers in hospitality industry should be multifaceted, meaning that except of the knowledge of their first-hand working environment, such as F&B, Front Office, Marketing, Accounting etc. they also attempt to learn to be interior designers, computer engineer or computer system analyst. The career of a hospitality manager is very challenging and requires variety of skills. In addition to that, managers are responsible for taking decisions that involved some type of legal dimension. Although, in this case a manager is not playing the role of an attorney, there is always a chance that the company will need the services of one (Travel Law, 2015).

The following report will describe the legal and regulatory issues applied in hospitality business. Scotland has been chosen as the venture of the research. Furthermore, relevant county’s legal and regulatory agencies will be observed and their influence on the operation of the hospitality business of the airlines. The examination of the following regulations and its impact on the working environment will include specific examples in order to illustrate the issues.


 

Introduction to Law

The first paragraph describes the definition of the law and the importance of its application in day-to-day life. Furthermore, the description of Scottish Legal System will be outlined.

2.1 Definition

Even the most qualified judge cannot know the full list of laws and regulations. However, it is not an excuse for a îòâåò÷èê to say that he was not aware of a particular rule being neglected. When an individual plans to open a business, òèïà ïðåäïîëîæèòåëüíî first of all he has to undertake the research concerning legal and regulatory issues. This is known as legal fiction (Wlaker, D, 2015).

That is why it is vital for those wishing to obtain a business in hospitality industry to understand the common principals that govern the preopening process working operations.

2.2 Sources of Law

In contradiction with what many people think, not only Parliament regulates the compiles the legal Acts. Criteria rendered by different governmental institutes, local authorities, corporations, such as CAA (Civil Aviation Authority) also have to be taken into account and followed. In order to find out what requirements a new or already excising business needs to fulfill an entrepreneur needs to consider the influence of each agency, thus avoiding any penalties (Wlaker, D, 2015).



Acts of Parliament are directing all types of commercial activities. Although, those rules apply to any type of business, there are some that are designed specifically for the travel and tourism industry, such as Air Travel Reserve Fund Act 1975. Scottish Parliament has the same power and rights as a United Kingdom Parliament, therefore their laws have the same effect (Wlaker, D, 2015).

2.3 The Scottish Legal System

The Kingdom of Scotland was completely isolated from England before 1707. During the period of its legal system development it was greatly influenced by France and its Roman origin law bases. Although, the two countries of Scotland and England share one monarch the government of Scotland Act 1998 re-designed the Scottish Parliament, thus making it partly independent and obtaining law-making abilities in majority of internal issues, as well as tourism (Wlaker, D, 2015).
