With gaining the independence of the Republic of Kazakhstan, foreign policy body has created its own legislative and treaty-legal base for consular maintenance of all-round communications of Kazakhstan with the external world. Every year the flow of foreign citizens into

Kazakhstan and its citizen's departure abroad are increased. In all cases leaving people should have visa support.

The system of visas gives the state an opportunity to supervise and to adjust entrance both foreign citizens and citizens of Kazakhstan.

Usually the visa policy is under the construction of a principle of reciprocity. Sometimes one state can fasten a visa mode that in its turn the appropriate state, which citizens are mentioned by restriction, corrects the visa policy.

The practice of non-visa mode is simultaneously widely distributed, on the basis of the special agreements between the countries. For example, there is an Agreement on non-visa movement of the citizens of the states of Commonwealth of the independent states on territories of its participants (1992). This agreement is made in interests of development of a good-neighborhood, strengthening of trade-economic, scientific and technical cultural and other communications of nine countries of CTS. The new independent state-participants of the Agreement are interested in development of co-operation of national consular services for the maintenance of effective protection of the rights and interests of the citizens of these countries.

At the same time national legislation of the state-participants of the Agreement has the right to establish restrictions on movement in their territory.

Former Soviet Baltic republics - Lithuania, Latvia, Estonia have accepted visa regime to the CIS citizens. The Kazakhstan part has accepted similar measures concerning the entrance of the citizens of these countries into its territory.

The change of a political and economic situation in the region has resulted that in 1999 Turkmenistan, being the participant of the Agreement of 1992, has accepted a visa mode for the CIS citizens. The single entry visa of Turkmenistan costs from 10 up to 40 US dollars depending on the term of a stay. For creation of conditions of entrance and departure of the citizens of the third states eight CIS countries have concluded an agreement on a mutual recognition of the visas of the state-participants of the Agreement (1992). Each side recognizes the entrance, exit, transit visas given to the foreign citizens by competent bodies of the parties. The citizens having such visas have the right free to follow destination in the third country. The given agreement entitles the foreigners on three-day time non-visa stay in territory of the countries -participants of the agreement with the business and service purposes.

In practice the weak parties of the made consular agreements are allocated. For example, in 1992 the Agreement on mutual trips of the citizens for the period of two years was signed between the Governments of the Republic of Kazakhstan and China, In the agreement it was provided non-visa order of entrance and departure irrespective of a kind of the foreign passport. The Kazakhstan part has found out in the certain time that the Chinese citizens supposed numerous infringements of the rules of a stay in Kazakhstan. Two new agreements were signed under the initiative of Kazakhstan in 1993 in Peking: the Agreement between the Government of the Republic of Kazakhstan and the Government of People's Republic of China about the order of registration of visas at mutual trips of their citizens (1993); The Agreement about the trip of the citizens on service businesses (1993) Non-visa order is kept only for the diplomats and owners of the service passports.

A little bit different procedure of registration of visas exists for the businessmen of India, Pakistan, People's Republic of China and Iran. The decisions on visa issue are accepted proceeding from practical expediency. Terms of consideration on the appeal for visa issue are reduced up to 5 days irrespective of short time visa. Additional consular points at some regional centers of Kazakhstan are open for acceleration of procedure of visas registration.

There are other agreements regulating mutual trips of the citizens: The Agreement between the Government of the Republic of Kazakhstan and the Government of Islam Republic of Pakistan about mutual trips of the citizens (1995); The Agreement on the simplified order of visa procedures for the businessmen of the member-countries of the of Organization of Economic co-operation (1995); "About the order of registration of entrance into the Republic of Kazakhstan and departure from the Republic of Kazakhstan of foreign citizens" (1995).

The Government of the Republic accepted additional measures in visa policy for the creation of favorable conditions for foreign trade and the improvement of an investment climate in Kazakhstan. The regulation of the Prime-Minister of December 31, 1996 is established the order of accelerated procedure of registration of visas for the known businessmen putting investment in economy of Kazakhstan and also

experts of leading firms of the USA, Great Britain, Germany, France, Italy, Japan and other countries.

As it is known, last years a flow of illegal persons in our Republic, smuggling of weapon and drugs has increased sharply. In this connection Kazakhstan is compelled partially to suspend the Agreement of 1992 " About a mutual recognition of visas of the state-participants of CIS ". Since February 2000 Kazakhstan has limited non-visas mode with the purpose of blocking a flow of illegal persons, smuggling of weapon and drugs and also various emissaries and mercenaries aspiring to penetrate through the CIS states into Chechnya. According to the accepted decision each foreign citizen can stay on the Kazakhstan territory no more than three days and only having of the transit visa. While non-visas is kept for the CIS citizens.

Cancellation of non-visas mode has entered in Bulgaria and Poland has started it. It is dictated by the necessity of adaptation of visa policy of Poland to the requirements of the European Union, the member of which it aspires to be.

For prevention of forgery of the Kazakhstan visas the new visas as labels adequate the international standards with nine degrees of protection now are entered. The entrance into the Republic of Kazakhstan and departure are authorized to foreign citizens only under their foreign passports at presence of the appropriate visa of RK.

The various categories of visas are: diplomatic, service, ordinary, private, tourist, on study, on work, on treatment, on constant living.
