Article 9. Entities vested with authority to prevent and combat discrimination

 

1. Entities vested with authority to prevent and combat discrimination are:

• the Verkhovna Rada of Ukraine;

• the Authorized Human Rights Representative of the Verkhovna Rada of Ukraine;

• the Cabinet of Ministers of Ukraine;

• other state authorities, the bodies of power of the Autonomous Republic of Crimea, and bodies of local self-government;

• community organizations, natural persons and legal entities.

 

2. Entities vested with authority to prevent and combat discrimination in order to achieve the purpose of this Law may apple affirmative action.

 

Article 10. Authority of the Verkhovna Rada of Ukraine Commissioner for Human Rights to prevent and combat discrimination

 

1. Verkhovna Rada of Ukraine Commissioner for Human Rights in the framework of parliamentary control over the observance of constitutional rights and freedoms of a human and a citizen, and protection of everyone in Ukraine and within its jurisdiction to prevent any form of discrimination, implements the following anti-discrimination measures:

 

Monitors the observance of the principle of non-discrimination in various spheres of social affairs, particularly in the private sphere;

 

Addresses a court with claims of discrimination in order to protect the public interest, and takes part in litigation in person or through a representative in cases and order established by law;

 

Monitors and summarizes the results of the observance of the principle of non-discrimination in various spheres of affairs.

 

Considers applications from individuals and/or groups of individuals on the matter of discrimination;

 

Keeps records and summarizes incidents of discrimination in various spheres of affairs;

 

Submits proposals to improve legislation on preventing and combating discrimination, application and termination of affirmative action;

 

Issues opinions in cases of discrimination upon a request of a court;

 

Covers the issues of prevention and combating discrimination and the the observance of the principle of non-discrimination in his or her annual report;

 

Cooperates with international organizations, relevant authorities of foreign countries on the matter of compliance with the international standards of non-discrimination;

 

Exercises other powers prescribed by the Constitution and laws of Ukraine.

 

Article 11. Authority of the Cabinet of Ministers of Ukraine to prevent and combat discrimination

 

1. The Cabinet of Ministers of Ukraine:

 

Provides a unified state policy aimed to compliance with the principle of non-discrimination in all spheres of social affairs;

 

Directs and coordinates the work of ministries and other central and local executive authorities on preventing and combating discrimination;

 

Takes into account the principle of non-discrimination in the adoption of legal acts;

 

Approves the procedure of the conduct of anti-discrimination expert analysis of the drafts of the legal acts by the executive agencies;



 

Exercises other powers in the sphere of combating discrimination established by law.

 

Article 12. Powers of the other state bodies, authorities of the Autonomous Republic of Crimea and local governments to prevent and combat discrimination

 

1. State bodies, authorities of the Autonomous Republic of Crimea and local authorities within their powers:

 

Submit proposals to improve legislation on preventing and combating discrimination;

 

Apply affirmative action policies;

 

Follow the principle of non-discrimination in their work;

 

Collaborate with community organizations on the matter of compliance with the principle of non-discrimination;

 

Promote scientific developments in the field of prevention and combating discrimination;

 

Conduct educational activities on preventing and combating discrimination.

 

Article 13. Rights of NGOs, individuals and entities to prevent and combat discrimination

 

1. Non-governmental organizations, individuals and legal entities shall have the rights to:

 

Participate in decision-making within public authorities, authorities of the Autonomous Republic of Crimea and local governments to prevent and combat discrimination;

 

Delegate their representatives to the advisory bodies on preventing and combating discrimination in case of their creation within the state authorities, authorities of the Autonomous Republic of Crimea and local governments;

 

Monitor on preventing and combating discrimination;

 

Represent individuals and/or groups of individuals who were discriminated against in the courts;

 

Conduct public anti-discrimination analysis of the drafts of legal acts;

 

Conduct other activities on the matter of compliance with the principle of non-discrimination in accordance with the law.
