Article 2. The principle of non-discrimination of legislation of Ukraine

 

1. The legislation of Ukraine is based on the principle of non-discrimination, which provides for the following, regardless of specific characteristics:

 

1) ensuring equality of rights and freedoms for individuals and/or groups;

 

2) ensuring equality under the law for individuals and/or groups;

 

3) respect for the dignity of every person;

 

4) ensuring equal opportunities for individuals and/or groups.

 

Article 3. Legislation on Preventing and Combating Discrimination

 

1. The law on preventing and combating discrimination comprises of the Constitution of Ukraine, this Law and other legal acts.

 

2. If an international treaty of Ukraine ratified by the Verkhovna Rada of Ukraine establishes other rules than those stipulated by this Law, the rules of the international treaty are applied.

 

Article 4. Scope of the Law

 

1. This Law shall apply to the relations between the entities of public and private law that are registered as located on the territory of Ukraine, as well as the individuals who stay on the territory of Ukraine.

 

This Law shall apply to the following areas of public affairs:

 

Social and political activities;

 

Public service and service in local government civil service;

 

Justice;

 

Labor relations, including the application of the principle of reasonable accommodation by the employer;

 

Healthcare;

 

Education;

 

Social security;

 

Housing;

 

Access to goods and services;

 

Other areas of public affairs.

 

Article 5. Forms of Discrimination

 

1. There are following forms of discrimination:

 

Direct discrimination;

 

Indirect discrimination;

 

Incitement to discrimination;

 

Aiding and abetting discrimination;

 

Oppression.
